These Terms of Service (“Terms”) govern your use of the mobile application Imagine (the “App”) offered by Digital Native(“we”, “us”, or “our”). By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

You must comply with the age and eligibility requirements of your app store (e.g. Google Play) and applicable law. If you sign in with a third-party provider (such as Google), you are also subject to that provider’s terms and policies where they apply to authentication.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App for your personal, non-commercial use in accordance with the store rules from which you obtained the App.

You may create or upload content (e.g. prompts, images). You represent that you have the rights necessary to provide that content. You grant us the license reasonably needed to operate, improve, and provide the App (including hosting, processing, and displaying content as part of the service). Details may be described in the Privacy Policy.
If the App offers paid features or subscriptions, purchases may be processed by Google Play or other platforms. Pricing, renewal, cancellation, and refunds are governed by the applicable store’s terms and policies. We do not control those payment processors’ rules.
The App may rely on third parties (e.g. authentication, analytics, ads, or cloud providers). Your use of those features may be subject to their terms. We are not responsible for third-party services we do not control.
The App is provided “as is” and “as available” to the fullest extent permitted by law. We disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement where allowed.
To the fullest extent permitted by law, Digital Native and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the App. Our aggregate liability for claims relating to the App is limited to the greater of (a) the amount you paid us for the App in the twelve (12) months before the claim or (b) fifty U.S. dollars (USD $50), unless applicable law requires otherwise.
We may suspend or terminate access to the App if you violate these Terms or if we need to comply with law or protect the service. You may stop using the App at any time. See Account & data deletion for how to request deletion of your account and associated data where available.
We may update these Terms from time to time. We will post the updated version at this URL and update the “Last updated” date. Continued use of the App after changes become effective constitutes acceptance of the revised Terms, to the extent permitted by law.
These Terms are governed by the laws of the jurisdiction you select in consultation with counsel (placeholder). Some jurisdictions give you mandatory consumer rights that cannot be waived by contract; nothing in these Terms limits those rights.
